Rental Contract

Payments
Once your reservation has been made, you have fourteen days until the first payment is due.  This payment is 50% or one-half of the total rent and all extra fees that may apply.  Full payment must be received 21 days prior to your arrival.  If you are making a payment in advance, you may pay with a personal check, certified check, or a money order.  Reservations made within 21 days of arrival must be paid with a certified check or money order sent overnight delivery.  Visa or MasterCard payments are accepted.  Personal checks are not accepted within 21 days of arrival.  When paying by money order or check please note the following:

• Please write reservation number on check or money order.
• Please mark your calendar with payment schedule, as we do not send reminders.
• A $25.00 handling fee will be charged for all returned checks.
• Please make check or money order payable to Snowshoe Properties Management, LLC

Final payment must be received within 21 days of arrival.  If the payment is not received within this time period, your reservation may be cancelled.  All reservations are subject to 6% sales and use tax, 6% occupancy tax and a $20.00 administrative fee.

ALL ADVANCE RENTAL PAYMENTS, BALANCES AND DAMAGE DEPOSITS ARE DEPOSITED IN SNOWHSOE PROPERTIES MANAGEMENT’S NON-INTEREST BEARING TRUST ACCOUNT AT CITIZEN’S NATIONAL BANK.  RENT PAYMENTS ARE DISBURSED TO PROPERTY OWNERS ON A MONTHLY BASIS.

Cancellations and Reservations Changes
Cancellations and reservation changes incur a $50.00 fee.  In the event that you must cancel your reservation, monies cannot be returned unless the property is re-rented at no loss to the owner.  If the property is re-rented for the same time period and at the same rate, a refund will be due to leaseholder (minus administrative fee) within 45 days.  If we are unable to re-rent the property, the full payment will be forfeited.

Transferring Dates
When you are faced with the possibility that your entire deposit will be forfeited, you may request a transfer in the same unit the same year.  When transferring from a higher rental rate season to a lower rental rate season, you will still be charged the higher rate.  When transferring from a lower rental rate season to a higher rental rate season, you will be charged the higher rental rate.  All transfers incur a $25.00 fee.

Security Deposit Waiver
While renting from Snowshoe Properties Management, we provide the following benefit to all our guests.  The Peace of Mind Plan:  The POM Plan covers theft or damage to the unit as a result of your inadvertent acts or omissions.  For a full description of the plan, please refer to the Description of Coverage detailing the terms, conditions and responsibilities of the Tenant and Snowshoe Properties Management, LLC.  If you do not receive a Description of Coverage upon the booking of your reservation, contact Snowshoe Properties Management, LLC for a copy.  The benefit of the POM Plan does not negate your responsibilities as a Tenant.  You must notify Snowshoe Properties Management of any damage or theft to the unit during your occupancy, or this plan is void and you will be held responsible for any damage to the unit.  The units are carefully inspected after each rental by Snowshoe Properties Management.  This Plan is provided to all of our guests as an additional service from Snowshoe Properties Management, LLC.

Check-in Procedures
Guests may check-in Sunday through Friday.  We do not offer Saturday arrivals or departures.  Check-in time is 4:00 p.m. with the exception of Holiday seasons during which check-in time is 5:00 p.m.  Due to the size and complexity of many of our homes and condominiums, our housekeepers need every minute of the 10am to 4pm window to ensure the cleanliness of your vacation home.  Please do not interfere with their work or pressure our staff to allow you entry before the above check-in times.  Please do not enter the home until you have received keys from our office.  Ski season can be hectic and sometimes it is necessary to delay check-in beyond 4pm, until your unit  is ready.  Your patience and understanding is appreciated as we prepare your vacation rental for occupancy.  Late arrivals must make special arrangements 24 hours prior to arrival.  It may be necessary for those who arrive after hours to stop by our office the following day to sign paperwork or credit card slips.

Keys
Upon arrival, you will receive two sets of keys in a check-in packet.  You may also receive a hot tub key, if applicable.  Keys will only be released to the person whose name appears on the reservation.  If you cannot be present upon check-in, please send authorization (in writing) to our office prior to your arrival.  When you depart, please return all keys to our office.  A $5.00 per key fee will be charged to the credit card on file if all keys are not returned.

Check-out Procedures
Sometimes it is hard to get moving on check out day, but please check out by 10am so that the property can be prepared for the next guest.  If you have questions concerning the check out procedure you may refer to your arrival packet or you may call our office and someone will assist you.

 Please make sure the following items are completed prior to departure:

• Trash must be bagged and taken to the garbage bins within the condominium complex or a trash shed if you are staying on West Ridge Road.  These trash sheds are located at each end of North and South Westridge Road.
• Wipe out and empty the refrigerator and the cupboards of all items you brought to the house.
• Gather all of your personal items.  We will not be responsible for any items left in the unit.  Lost and found items not claimed after thirty days are turned over to a local charity.
• Leave furniture and TVs/VCRs/DVDs arranged as you found them.
• In cold weather, please leave thermostats turned to 68 degrees and make sure all fires have been extinguished.
• Please do a final walk through to check that doors and windows are closed and locked and that all lights are turned off.

We will charge the credit card on file a fee (minimum of $50.00) if the property is not left in acceptable condition.

Accommodations
All of our homes are individually owned and reflect the taste and style of each owner.  Every effort is made to ensure that our descriptions, rates and amenities are accurate.  However, we cannot be held responsible for changes made by owners to furnishings, rates and equipment or printing errors.  Our homes are well maintained and very clean, but understand that these are unique and intricate homes, which just like your own, experience a wide variety of unexpected breakdowns.  Snowshoe Mountain is rapidly growing and new construction is evident throughout the area.  If you rent a home near construction, please be tolerant of the possible additional noise and other concerns.  Please realize that this is a situation beyond our control and we will not issue refunds or move you to another property.

We want you to have a wonderful vacation and enjoy yourself, which is why we make every effort to remedy unpleasant situations and correct any problems you might experience in a timely manner.  Please notify us promptly if you experience inoperative equipment or other problems.  Please understand that emergencies do take precedence.  You can expect a courteous and professional staff to help remedy the situation; however, refunds will not be issued due to malfunctioning equipment or other guest dissatisfaction.  Please keep in mind that due to the remoteness of our location and the inability to obtain replacement parts quickly; immediate servicing of malfunctioning units is not always possible.  Owners and Snowshoe Properties Management, LLC have the right to enter and reasonably inspect the property during your occupancy and make repairs to its fixtures, appliances, furnishings and facilities.

Reservations
Snowshoe Mountain is a four-season resort and as such we are open for reservations year round.  However, our office hours change depending upon the season.  Throughout the summer, reservationists are available daily from 9am until 5pm.  During the winter season, we are open daily from 9am until 10pm, except Saturday’s 9am until 5pm.  Accessing our web site at www.snowshoevacationrentals.com will provide you with detailed information as well as an up to date listing of all our homes and condominiums.  To make a reservation, please call 888-577-7823 or go to our web site and book online.

Family Group & Occupancy
All of our vacation homes are privately owned and therefore occupancy is limited to family groups only.  No fraternities, school, civic or other non-family groups are allowed.  No one under 24 may obtain a rental agreement on a property or pick up a key for a property.  If a group misrepresents themselves they will be evicted immediately without refund.  The maximum number of persons allowed is designated on your rental agreement and in the vacation brochure.  Occupancy count does include children.  Any party exceeding this number will be evicted immediately without a refund.

Pets
We do offer pet friendly homes and condominiums.  You can find these units marked in our brochure and on our web site.  Pets are limited to two, medium sized, house broken dogs.  All other animals are not allowed. A $200.00 PET DEPOSIT IS REQUIRED and refunded after departure, if no damage is found to the unit.   Pets found in non-pet properties are forbidden and will result in immediate eviction without refund and incur a $200.00 charge to the credit card on file.  Pet damages are not covered by the Peace of Mind Insurance and your credit card will be billed if there is damage to the unit in excess of the $200.00 PET DEPOSIT.

Owner’s Closets
Each unit has locked closet(s) or areas , which are not available to guests.  Our staff checks these doors after each departure.  Please respect the privacy of our homeowners while they are sharing their home with you.  If any of  these areas are  tampered with, you will be held responsible.

What Is Provided
Linens are provided as a courtesy to all of our guests.  This includes one towel and washcloth per person and all bed linens.  A kitchen towel is also provided.  Please make sure that all linens stay when you leave.  Toilet paper, trash bags, bath soap and dishwashing soap/detergent are provided at no additional cost.  All homes feature standard items that include the following:  coffee maker, toaster, pots and pans, dishes, utensils and glassware.  All units are equipped with a telephone that allows the caller to make local calls.  A calling card may be used for long distance calls.  If the telephone service is interrupted we will make every effort to correct the problem but cannot guarantee replacement or repair.  Hot tubs, porch furniture, grills, air conditioning and recreational games or equipment are courtesies provided by the individual homeowner and are not guaranteed.  Refunds will not be given if there is a breakdown.

Winter Reservations
We have a large amount of snowfall from November through March.  You MUST be prepared with four-wheel drive, snow tires and in extreme weather, chains.  If you have reserved a home you MUST have four-wheel drive and chains.  Firewood/propane is provided for our winter guests.  Please make sure fires are extinguished before departing, but please leave hot ashes in the fireplace.  Read and carefully follow the directions for the gas fireplaces.  Under NO circumstances should the fire logs in gas fireplaces be removed and/or rearranged.  Please make sure the flue is open before using a log fireplace.

Unfortunately, there are circumstances that arise in which we have little or no control and there are rare occasions in which we may be unable to allow occupancy in your reserved unit.  Circumstances beyond our control may include fire, eminent domain, construction, sale of property, lack of water/sewage or acts of nature.  Snowshoe Properties Management, LLC and homeowner’s sole liability for any of the above circumstances is a full refund.  Leaseholder acknowledges that in no event shall Snowshoe Properties Management, LLC or homeowner be held liable for any consequential or secondary damages, including but not limited to expenses incurred as a result of travel costs.  Leaseholder also agrees that in the case of double booking, leaseholder will be entitled to a full refund and we will make all attempts to relocate leaseholder.  Leaseholder agrees to release, to indemnify and to hold harmless, the Homeowner and his Agent from and against all liability for injury to the person of the Tenant or to any member of his/her household resulting from any cause whatsoever, except personal injury caused by the neglect or intentional acts of the Owner or his Agent.  No refunds will be made due to unfavorable weather or disruption of utility services (including cable and/or satellite TV).  Leaseholder agrees to be responsible for any repairs due to his/her negligence.  This agreement shall be binding at the time of reservation when Tenant, as a guarantee, gives Agent credit card number.  Tenant acknowledges that they might not have possession of the premises until full rental amounts set forth herein have been paid.  The terms and conditions as set forth above are incorporated by reference as if fully set out.  IN WITNESS WHEREOF, this agreement is executed in two counterparts, on being retained by each party hereto:
